What AI does well

Patent drafting has a lot of structure: claim trees, embodiments, consistent terminology, reference numerals, and standard sections. AI trained for that workflow can turn a good technical disclosure into a complete draft far faster than starting from a blank page, and can propose variants you had not written down.

What AI cannot do

AI is not an inventor. Patent offices and courts in several countries, including in the DABUS cases, have held that inventors must be natural persons. The technical contribution must come from people. AI also cannot know facts you did not give it, and it can produce errors or invented references.

General chatbots versus patent software

Pasting an invention into a consumer chatbot raises two issues: confidentiality, because some consumer services may use conversations to improve models, and structure, because a general chat does not keep your prior art, claims, drawings, and versions connected. Patent-specific software should state clearly how it handles your data.

How to use AI safely

• Provide a complete, accurate technical disclosure
• Verify every technical statement and every cited reference
• Check that the claims are supported by the description
• Use tools that do not train on your data
• Review before filing or have the draft professionally reviewed
